HB2021 HFA Pushkin & Fluharty 3-3

            Delegates Pushkin, Fluharty, Eldrigde, Marcum and Rodighiero move to amend the bill on page 2, following the enacting clause, by inserting the following:

            That the Code of West Virginia, 1931, as amended, be amended by adding thereto a new section designated §5A-3-21; that said code be amended by adding thereto a new section, designated §9-3-6, all to read as follows:

CHAPTER 5A. DEPARTMENT OF ADMINISTRATION.

ARTICLE 3. PURCHASING DIVISION.

§5A-3-21. Vendor drug testing.

            Every vendor shall have and implement a drug testing policy that comports to the legislative rules of the director for drug testing of vendors. The failure of a vendor to have an approved drug testing policy shall subject that vendor to debarment from future state government contracts until the director is satisfied that the testing program implemented by the vendor meets the requirments of this section. The Director shall promulgate legislative rules pursuant to article three, chapter twenty-nine-a of this code implementing the provisions of this section.”
